Defaulting Tenants Can Be Evicted In 15 Days

In what must surely be a sign of the times Congres have passed the new law Ley de Fomento del Alquiler y de Eficiencia Energética de los Edificios to give more power to landlords to evict tenants that default on rental payments in Spain.

Two reasons have been given for the law that is due to come into force in May 2010:

  • Provide landlords with a greater security and power over defaulting tenants
  • Free up more properties for rental

The first is fine. The second seems rubbish as there are more than enough empty properties around desperate for tenants!!

Traditionally Spain isn’t a huge rental market, but with mortgages harder to get hold of maybe that will start to change soon.

    Is good they are tightening it up but 15 days is no time at all! You could come back from holiday to find a cheque failed to clear and you had been evicted!
