Almerimar Property - Buying Re-Sale

This article gives a rough guide to the buying process for re-sale properties:

Once you have found a second hand property that you want to buy, and your offer has been accepted (unlike making a non-bindng offer in the UK), in Spain you will be asked to sign a reservation contract, or in some cases a more detailed private sales contract. This also requires you to pay a small deposit usually in the region of 3000€.

Your lawyer then carries out the necessary legal investigations. When these are complete, you sign a contract of sale, which states the price and what it covers, the deposit (generally 10 per cent) and when you will pay it, and the date of completion. Should you breach the contract, you forfeit your deposit. Should the seller breach it, they must pay you twice the amount of the deposit.

Once completion has taken place, various fees and taxes are payable, and the property is then registered at the Land Registry. Typical fees come to between 10 and 12 % of the purchase price and include:

- Legal fees (usually between 1 and 2 per cent)
- IVA (Spain’s equivalent of VAT) at around 7 per cent
- Stamp duty at 6–7 per cent (depending on the property’s location)
- Notary and property registration fees of about 1 per cent

    I would like to specify a few things about this matter:

    When you buy a second hand property you do not pay IVA, instead you pay what it is called “Impuesto de Transmisiones” which is the equivalent to the English Stamp Duty of a 7%.
    Also something which concerns me as a soliccitor is that people see normal to pay between 1% and 2% of the price for Legal Fees! In some areas as Costa del Sol these percentages are even higher but I always thought that is a very high fee to pay! In normal conditions, the legal work for a house that costs 100,000€ and one of 500,000€ are the same! so why pay more? You should pay fees depending in the work done, not in the selling price!
